Welcome to Hjezle. These Terms and Conditions ("Terms") govern your access to and use of the Hjezle appointment booking platform available at hjezle.com, including any subdomains, mobile applications, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Definitions

• "Hjezle", "we", "us", "our" refers to Hjezle, the operator of the platform.
• "Business Owner" refers to users who create a business account to manage appointments and services.
• "Customer" refers to end users who book appointments through a Business Owner's booking page.
• "User" refers to any individual who accesses or uses the Service, including Business Owners and Customers.
• "Tenant" refers to a Business Owner's dedicated workspace on the platform, accessible via a unique subdomain.

2. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using the Service on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.
• Each Business Owner receives a unique subdomain (e.g., yourbusiness.hjezle.com) which must not infringe on any third-party trademarks or rights.

4. Service Description

Hjezle is a multi-tenant appointment booking platform that enables Business Owners to:

• Create and manage online booking pages
• Define services, pricing, and availability
• Manage staff members and their schedules
• Accept and manage customer appointments
• Send automated booking confirmations and reminders
• Track business analytics and customer data
• Customize branding and appearance

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.

5. Subscription and Payments

• Hjezle offers free and paid subscription plans. Features and limits vary by plan.
• Paid subscriptions are billed on a recurring basis (monthly or annually) as specified at the time of purchase.
• All fees are non-refundable unless otherwise stated or required by applicable law.
• We reserve the right to change pricing with at least 30 days' notice. Price changes will take effect at the start of your next billing cycle.
• Failure to pay may result in suspension or downgrade of your account.
• You are responsible for any applicable taxes associated with your subscription.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Impersonate another person or entity
• Upload or transmit malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to any part of the Service or its systems
• Interfere with or disrupt the Service or servers
• Scrape, crawl, or use automated tools to extract data from the Service without permission
• Use the Service to send unsolicited commercial messages (spam)
• Sublicense, resell, or redistribute the Service without our written consent
• Use the platform for any activity that is discriminatory, abusive, or harmful

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Hjezle and are protected by copyright, trademark, and other intellectual property laws.

• You retain ownership of any content you upload to the Service (logos, images, business data).
• By uploading content, you grant Hjezle a non-exclusive, worldwide license to use, display, and process your content solely for the purpose of providing the Service.
• You may not copy, modify, or create derivative works of the Service or its technology.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the practices described in the Privacy Policy. Business Owners are responsible for ensuring their own compliance with applicable data protection laws when collecting and processing customer data through the Service.

9. Business Owner Responsibilities

As a Business Owner, you are responsible for:

• The accuracy of your business information, services, pricing, and availability
• Honoring appointments booked through the Service
• Complying with all applicable laws and regulations related to your business operations
• Managing your staff accounts and their access permissions
• Ensuring your use of customer data complies with applicable privacy laws
• Providing clear cancellation and refund policies to your customers

10. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
• Hjezle does not guarantee uninterrupted, secure, or error-free operation of the Service.
• Hjezle is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• Hjezle is not responsible for disputes between Business Owners and their customers.
• Our total liability shall not exceed the amount you paid to Hjezle in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold Hjezle harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

• You may terminate your account at any time by contacting us or through your account settings.
• We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice.
• Upon termination, your right to use the Service ceases immediately.
• We may retain certain data as required by law or for legitimate business purposes.
• Provisions that by their nature should survive termination will remain in effect (including Sections 7, 10, 11, and 14).

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date and, where appropriate, notifying you via email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first, and if unresolved, through the competent courts of the UAE.

15. General Provisions

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Hjezle.
• Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force.
• Waiver: Failure to enforce any right or provision does not constitute a waiver of that right.
• Assignment: You may not assign your rights under these Terms without our written consent.
